  • How much does it cost to get a trademark?
We have created a special cost-effective package for filing your trademark with us as a small business or start-up. Get in touch with us to get a fee quote.
  • Someone is already using a similar trademark, can I still register it?
It would not be recommended to file a similar trademark because your trademark could be rejected for creating confusion among consumers. However, if the other mark is being used for different types or products and/or services then it would be possible for you to get the trademark because it will not cause any confusion between the brands. For example, take the trademark "Dove". Dove (Beauty) and Dove chocolates can coexist because their products are different enough to prevent confusion among customers.
  • How do I know how many classes to register my trademark in?
You should protect your trademark for the products and services you offer and include your expansion plans in the next 5 years. For example, if you have a clothing business, that you currently retail online. You would file a trademark under the classes that protect all the products you are selling online. You also think that in 5 years your clothing brand may expand to include bags and accessories. These items are in different classes. When you put it all together, your clothing brand retailing online would likely need to be protected in 4 classes.
  • What should I do if someone infringes my trademark rights?
If someone infringes your trademark rights, you can take legal action against them to stop them from using your mark and claim damages for any losses you have suffered. It is recommended to consult with an attorney for advice on how to proceed. Get in touch with us!
  • Why should I file a trademark application in the United States?
Filing a trademark application in the United States can help protect your brand and prevent others from using or registering a similar mark. It also gives you the exclusive right to use the mark in connection with your goods or services.
  • What is the filing stage?
This is the first stage in the trademark application process. This is where we file your application with the USPTO, and we have all the filing particulars in hand, including your classes with your list of goods and services.
  • What is the examination stage?
This is the second stage in the trademark application process. After your application is filed, it will take four to six months for your application to be assigned to an examiner who will review the application to ensure that it complies with the rules and regulations, including whether it is registrable as a trademark and whether any other party has filed a similar earlier mark that would block your application. The fees here depend on whether the USPTO raises any objections against your application and cannot be estimated yet.
  • What is the publication stage?
This is the third stage in the trademark application process. This is where we report that your application has passed the examination stage and has been published in the Journal for any third party who might wish to oppose your application.
  • What is the registration stage?
This is where we receive and forward the certificate of registration to you. It is the last stage in the Trademark application process.
  • What happens after my trademark is registered?
Once your trademark is registered, you will receive a certificate of registration from the USPTO. This gives you the exclusive right to use the mark in connection with your goods or services in the United States for a period of 10 years, with the option to renew.
  • What information do I need to provide in my trademark application?
You will need to provide the details of the mark you want to register, such as the name, logo, or image. You will also need to specify the goods or services you want to use the mark for and provide us with information about yourself or your business.
  • What is an office action?
An office action is a communication from the USPTO that identifies issues or objections with your trademark application. This could be due to conflicts with existing marks or insufficient information provided in your application.
  • What should I do if I receive an office action?
If you receive an office action, it is important to carefully review the issues or objections raised by USPTO and respond promptly with a suitable response. This may involve providing additional information or making amendments to your application. We offer special packages for overcoming official refusals from USPTO. Get in touch with us.
